Online Auction Buyer’s Agreement & Disclosure


Auctioneer: Tri-State Auctions

Effective Date: September 09, 2025


By registering for a bidder account and participating in any online auction hosted by Tri-State Auctions (hereafter referred to as "the Company"), the Bidder agrees to the following legally binding terms and conditions.

1. Nature of the Sale

  • "As-Is, Where-Is": All items are sold in their current condition with all faults, visible or otherwise. The Company makes no warranties, expressed or implied, regarding the merchantability or fitness of any item for a particular purpose.
  • No Returns: All sales are final. No refunds, exchanges, or chargebacks will be permitted.

2. Bidding Obligations

  • Contractual Commitment: Every bid placed is a legally binding contract. If you are the high bidder and the bid is accepted, you are obligated to complete the transaction.
  • Bidder Responsibility: Bidders are responsible for protecting their account credentials. Any bid placed under your username is your financial responsibility.
  • Due Diligence: While the Company provides descriptions and photos, these are for identification purposes only. It is the Bidder's responsibility to inspect items (via scheduled preview dates) prior to bidding.

3. Financial Terms

  • Buyer’s Premium: A buyer’s premium of 10% will be added to the final hammer price of each item.
  • Sales Tax: Applicable state and local sales tax will be applied unless a valid tax-exempt certificate is provided to the Company before the close of the auction.
  • Payment Deadline: Payment must be made in full at the close of the auction.  Accepted payment methods include Credit Card, Cash, or Check.
  • Payment Processing Fee: Any payments made with debit or credit cards will incur a 3% processing fee. 
  • Payment Processing: Payments will be processed to the card that is on file at the time of registration, at the close of the auction, unless cash option arrangements have been made by email, 24 hours before the close of the auction. Emails should be sent to contact@tri-state-auctions.com.

4. Removal and Shipping

  • Removal Period: Items must be picked up during the designated checkout window: Fridays, 9:00 am until 5:00 pm, and Saturdays, 9:00 am until 1:00 pm.
  • Abandonment: Items not removed within the specified timeframe will be considered abandoned. The Company reserves the right to resell or dispose of abandoned items without refund to the original purchaser.
  • Shipping: Shipping is the sole responsibility of the Buyer unless otherwise stated. The Company is not liable for damage occurring during the shipping or loading process.

5. Liability & Technical Issues

  • Liability Waiver: Tri-State Auctions is not responsible for any injury, damage, or loss incurred during the preview, auction, or removal process.
  • Technological Failures: The Company is not responsible for missed bids due to internet outages, software lag, or technical malfunctions on the Bidder's end.

6. Soft Close (Extended Bidding)

  • Dynamic Ending: All lots in this auction are subject to a "Soft Close." If a bid is placed within the final 45 seconds of a lot’s scheduled closing time, the bidding period for that specific lot will automatically extend for an additional 45 seconds.
  • Continuation: This process will continue until a full interval has passed without any new bids being placed. At that point, the lot will be considered "Sold" to the highest bidder.
  • Purpose: This feature is designed to simulate a live auction environment, ensuring that the highest bidder is determined by price, not by the speed of an internet connection or last-second software "sniping."
  • Independent Timing: Please note that while one lot may extend, other lots in the same auction may close as scheduled if no late bidding occurs on those specific items.

Market values for furniture are subject to change and vary based on condition, provenance, and current demand. If you require a certified valuation for legal or financial purposes, we recommend consulting a member of the American Society of Appraisers (ASA) or the International Society of Appraisers (ISA).
